A foreign national who marries a Turkish citizen does not become a citizen at the moment of marriage. On this route marriage is not an outcome but a precondition: once three years are complete the right to apply arises, and the authority that takes the decision is the Ministry of the Interior.
This article explains which three conditions the right to apply depends on, how these conditions are checked in practice, and what happens where the marriage comes to an end during or after the process. The document list and the cost items are the subject of separate articles; there are links to them below.
Who this route is for
Application through marriage is a regime separate from the general route. Whereas the general route requires five years of uninterrupted residence, what is required on this route is the duration of the marriage. The choice between the two routes is not in the person's hands; you apply through whichever route your circumstances meet.
The point to note is this: being able to apply through the marriage route does not mean that the application will be accepted. Because this route is seen as open to abuse, it is one of the routes examined in the greatest detail in practice.
The three conditions and what each one means
The Law requires the three conditions together. If one of them is missing, the application does not reach a conclusion.
1. Having been married for at least three years
The three years is the period from the date of the marriage to the date of the application. An application made one day before the three years are complete does not meet the duration condition. A marriage contracted abroad has to be registered in the civil registry in Türkiye; where the marriage is not registered, the duration becomes open to dispute.
2. The marriage subsisting at the time of the application
Having completed three years is not enough; the marriage also has to be subsisting at the moment the application is made. Someone who stayed married for four years and then divorced cannot apply through this route. If the divorce takes place during the process, the file falls away.
3. Living within the family unit
The third condition is the hardest one to show with documents. The Law requires not an official marriage record but a family life actually maintained together. The file of spouses who live at separate addresses and do not know basic facts about each other's lives is concluded unfavourably on this condition.
How family unity is checked
The check does not rest on a single document; what is looked at is whether the information coming from several channels is consistent.
Address registration and on-site inspection
The spouses' addresses in the civil registry are expected to be the same. In practice the address is also inspected on site; what is looked at is whether there are signs of the couple living together in the home.
Statements from those around you
During the inspection, questions may be put to neighbours, the building management or the neighbourhood head (muhtar). These statements are not decisive on their own, but if they conflict with the other information in the file they raise a question mark.
The process: from application to decision
The file passes through several authorities in turn. Each link has its own timescale, and the total time depends on the slowest link in the file.
Application and preliminary examination
The application is made to the provincial governor's office of the place of residence in Türkiye, or abroad to a Turkish diplomatic mission. At the preliminary examination the duration of the marriage and the completeness of the documents are checked.
The police investigation
The provincial police headquarters carries out an archive search and an investigation. Fingerprints are taken; the address, means of subsistence and past periods of stay are examined. This investigation is known to be treated as valid for one year; if the file does not reach a conclusion within that time it may need to be renewed, and this is one of the known causes of delay in long-running files.
The commission interview
The Citizenship Application Examination Commission within the provincial governor's office calls the spouses to an interview. The subject of the interview is not knowledge of the law; it is ordinary information about shared life.
The spouses being heard together and separately
On the marriage route the spouses are heard both together and independently of each other. The purpose of hearing them separately is to see whether the two accounts are consistent. Being prepared here does not mean learning things by heart; what gives rise to an inconsistency is usually not untruth but not remembering dates and names.
What happens if the marriage comes to an end
What the outcome will be depends on the stage at which, and the reason for which, the marriage came to an end.
Divorce during the process
Because there is a condition that the marriage be subsisting at the time of the application, a divorce that takes place before the decision leaves the file without a result.
Death of the spouse
Where the spouse has died, the condition of living within the family unit is not required. Because death is an ending that does not arise from the person's own conduct, a protection has been introduced to this effect.
Divorce after citizenship has been acquired
Divorcing after citizenship has been acquired does not take away the right acquired. Citizenship is not a status dependent on the marriage continuing.
Annulment of the marriage
Where the marriage is annulled, the foreign spouse who acted in good faith keeps the citizenship they acquired. The criterion here is good faith; if it is established that the marriage was entered into solely for the purpose of citizenship, the outcome is different.
Two points that get confused
Citizenship does not pass to a spouse of its own accord. The spouse of a person who is a Turkish citizen is not deemed a citizen merely by virtue of that; they make their own application.
A residence permit and citizenship are not the same thing either. A foreign national married to a Turkish citizen may obtain a family residence permit; that permit gives the possibility of staying in Türkiye and, under certain conditions, of working, but it is not citizenship status.
Four situations that weaken a file
- The addresses in the spouses' civil registry records being different, with no explanation for it
- A marriage contracted abroad not having been registered in Türkiye
- The spelling of the name in the passport not matching the spelling in the Turkish records
- The certification chain for foreign documents being set up incompletely, and the file coming back for that reason
What we do on this route
We establish which route the file will take, draw up the document list, set up the certification chain for foreign documents and follow the process through a single person responsible up to the interview. We do not book appointments with the institutions on your behalf; you book the appointment yourself, and we tell you what needs to be done when choosing a date. The initial consultation is free of charge, and at the end of the meeting we give you the fee in writing.
Legal basis
Acquiring citizenship through marriage is regulated in article 16 of Turkish Citizenship Law No. 5901 and in the Regulation on the Implementation of the Law. The deciding authority is the Ministry of the Interior. Meeting all of the conditions does not oblige the administration to grant citizenship; the Law gives the administration a discretionary power.
Legislation and administrative practice may change. The information on this page is for general guidance only; an assessment specific to your case requires a consultation.
