What is decisive in a work permit extension application is not the quality of the file but the date of the application. The legislation has drawn a narrow time window for extensions; once that window is missed, the application no longer counts as an extension, and the duration tier earned over the years is lost.
This article explains when the window opens and closes, how many years an extension permit is granted for, what changes when the employer changes, and whether it is lawful to work while the application is pending.
The difference between an extension and a new application
An extension is a procedure that continues the existing permit, and it has two important advantages: a longer duration can be granted, and the process is built on the existing file. A new application, by contrast, is assessed from scratch and the duration to be granted is limited to one year. The only thing that draws the line between the two is the date of the application.
Timing: the sixty-day window
An extension application can be made from the point at which sixty days remain before the permit expires, and in any event it has to be made before the permit expires.
The earliest limit
No application can be made earlier than sixty days before. A mistake employers often make is applying far too early so as not to miss the deadline; such an application is not assessed.
The latest limit
The last day is the day the permit ends. The window as a whole is sixty days, but in practice, because preparing the file takes time, it is right to apply in the first half of the window.
What happens if the deadline passes
An extension application not made within its time limit is one of the grounds for refusal listed in the Regulation. The Ministry states that extension applications made after the permit has ended will be assessed subject to the procedures and principles for first applications. In practice the result is this: the application is not accepted as an extension, it is assessed from scratch, and the duration to be granted is at most one year. There is no additional number of days allowed for a delay.
The consequence on the residence side
Because a work permit takes the place of a residence permit, the right of residence also ends when the permit ends. A foreign national left without a valid residence permit is expected to leave the country within ten days. While an objection or a court case is pending, this obligation does not apply.
How many years an extension permit is granted for
The durations lengthen in tiers, and the tier depends on continuing to work for the same employer.
- At most one year on the first application
- At most two years on the first extension with the same employer
- At most three years on subsequent extensions
An independent work permit is not subject to these duration limits. The value of the tier can be seen here: if a file that could obtain three years at the third extension drops to one year because the window was missed, what is lost is not only the duration but the application burden of the following years.
If the employer changes
A work permit is tied to the employer and cannot be transferred. An application made in order to work for a different employer is assessed, under the Regulation, according to the procedures and principles for first applications. In other words, when the employer changes it is a new application rather than an extension, and the duration is again limited to one year.
A change of branch or position within the same employer is regulated separately; such changes are notified through the system and are subject to the Ministry's approval.
What is required for an extension
The Regulation contains no separate, lighter set of criteria for extensions. What is required is that the conditions met on the first application continue to be met.
Conditions that must continue to be met
- The workplace continuing its activity
- Social security and tax debt status being in order
- The salary being paid through a bank and complying with the salary tariff specific to foreign nationals
- The proportion of foreign employees at the workplace staying within the limit
The limit on staying abroad
Unlike a first application, an additional element enters the assessment for an extension: the foreign national is required not to have stayed abroad for more than six months in total within the last year. Long-term postings abroad should therefore be reviewed before an extension.
The employment condition: the sources conflict
The requirement of five Turkish employees per workplace appears not in the Law but in the assessment criteria determined by the Directorate General. It is reported that a change was made to these criteria in 2026 and that an exemption up to a certain number per workplace was introduced for foreign nationals meeting certain conditions. The sources do not agree on the scope of this exemption, however; some define it only for first applications made inside the country, while no source explains directly what effect it has on extension applications.
For that reason we do not state anything definite here. If you are building your file on these criteria, it needs to be confirmed from the current text of the criteria before the application.
Can you work while the application is pending?
The Regulation allows for this: while the application is being assessed after the permit has expired, work may continue provided that it does not exceed ninety days in any event and that the work done and the workplace do not change. Both conditions are binding: if the job or the workplace changes, this possibility falls away.
The application certificate (müracaat belgesi)
On request, a work permit extension application certificate not subject to any charge or fee is issued. This document is useful where the application has to be shown to have been made, and it is not issued of its own accord unless it is asked for.
How long the application takes to conclude
As a rule, an application that is in proper form and complete is concluded within thirty days. If documents are missing, the employer is given up to thirty days and the application is suspended; time spent suspended extends the timetable.
Objection in the event of refusal
An objection may be lodged with the Ministry within thirty days from the date of notification of the refusal decision. If the application is left unanswered, the same period runs from the end of the thirty-day decision period. An objection is not a compulsory route; where the objection is refused or left unanswered, an action for annulment may be brought before the administrative courts.
The employer's timetable
The extension process is built on a single date, and that date is the day the permit ends. The practical rule: mark sixty days before the permit ends in your calendar, start collecting documents at least two weeks before that day, and make the application in the first half of the window. That way, if a document turns out to be missing, there is still time to put it right.
At workplaces employing more than one foreign national we keep this calendar per person and let you know as the end dates approach. The initial consultation is free of charge; at the end of the meeting we give you the document list and the fee in writing.
Legal basis
The extension of a work permit is regulated in Law No. 6735 on International Labour Force and in the Regulation on the Implementation of the Law on International Labour Force. Applications are assessed by the Directorate General of International Labour Force. The assessment criteria are determined by the Directorate General and are updated periodically; the current criteria need to be confirmed before the application.
