What is decisive in a residence permit extension is not the quality of the file but the date of the application. The legislation has drawn a narrow time window, and once that window is missed the application does not count as an extension.
This article explains when the window opens and closes, what happens if you are late, the right to stay in Türkiye after the application, and the terms granted according to the type of permit.
The application window: sixty days
An extension application is made from the point at which sixty days remain before the residence permit expires and, in every case, before the permit expires. There is no minimum waiting period; an application can be made as soon as the window opens.
Applying early does not cost you time
A common worry is this: if I apply early, do my remaining days go to waste? They do not. The extended permit starts from the lawful end date of the existing permit. That is why applying in the first half of the window is safer in every respect.
The ten-day tolerance
The Regulation provides that applications will also be accepted from those who have exceeded their residence permit or visa period by up to ten days.
Where the fifteen-day figure comes from
Some sources give this tolerance as fifteen days. The text of the Regulation says ten days; fifteen days may arise from confusion with another rule, the rule that each exit abroad with an application certificate must not exceed fifteen days. Plans should not be made in reliance on the tolerance.
The cost of missing the window
A late application creates the risk of the application not being accepted, and the position of a foreign national left without a valid residence permit turns into a breach. A record of a breach increases the weight on the file in later residence and citizenship applications. That is why the calendar has to be built not on the tolerance but on the first half of the sixty-day window.
What happens after the application
When the application is received, the foreign national is given a residence permit application certificate. This document is not subject to any charge or fee, and its most important function is this: even if the permit period has expired, it gives the right to stay in Türkiye until the application is concluded.
Going abroad with the application certificate
Provided that the charge has been paid and that the stay has been within the period requested, multiple exits and entries are possible. Each exit must not exceed fifteen days.
How long the application takes to conclude
The application is concluded within ninety days at the latest from the date on which it is taken into processing. If a missing document is notified, thirty days are given to complete it, and that period extends the timetable.
If the deadline is missed
Where you fall outside the ten-day tolerance, the application is not accepted as an extension; the new application route is taken instead. A deportation decision is taken in respect of a foreign national who breaches the permit period by more than ten days without an acceptable reason. For the period of the breach, the residence permit charge is collected at double the amount.
How many years each permit is granted for
- Short-term residence permit: a maximum of two years at a time
- Family residence permit: a maximum of three years
- Student residence permit: one year at a time, provided it does not exceed the period of study
- Long-term residence permit: indefinite, no extension needed
For those who obtain a short-term permit within the investor category and for citizens of the Turkish Republic of Northern Cyprus, this limit can rise to as much as five years.
Something else that is looked at on an extension: days abroad
Unlike a first application, past periods spent abroad enter the assessment on an extension. For a short-term residence permit, a stay abroad exceeding one hundred and twenty days in total within the last year, and for a family residence permit a stay exceeding one hundred and eighty days, is a ground for the permit not being granted or being cancelled.
The sources do not entirely agree on these thresholds: some argue that the limit on the short-term permit has been removed. The text of the Regulation appears to keep the limit; it is therefore right to plan long programmes abroad without relying on the threshold.
Passport validity
The passport has to be valid for at least sixty days longer than the permit period requested. Files where the passport is about to run out come unstuck at the application stage for this reason.
Do those with a work permit also make an extension?
They do not. A valid work permit and a work permit exemption confirmation document count as a residence permit; a work permit extended in due form also continues the residence permit for the same period, and a separate residence extension is not needed. The exception to this is work permits granted to applicants for international protection, to conditional refugees and to those under temporary protection; these do not take the place of a residence permit.
If refused
If the extension is refused, the foreign national is given a document, not subject to any charge, granting the right to stay for up to ten days. An action for annulment may be brought before the administrative court within sixty days from the date of notification of the decision.
Bringing a court case does not give a right to stay
An important detail: having brought a case does not of itself give rise to a right to stay in Türkiye. A stay of execution has to be requested separately. The time limit for a case against a deportation decision, on the other hand, is seven days, and in that case the foreign national is not deported until the case is concluded.
The one date to put in the calendar
Mark the day sixty days before the permit ends, start collecting documents at least two weeks before that day, and make the application in the first half of the window. Where there is more than one family member, we keep the calendar per person and let you know as the end dates approach. The initial consultation is free of charge.
Legal basis
Residence permit extension is regulated in article 24 of Law No. 6458 on Foreigners and International Protection and in articles 21 and 22 of the Regulation on the Implementation of the Law. Applications are made to the provincial governor's offices; in practice the procedures are carried out through the e-ikamet system.
